1. Introduction
Welcome to 12 O’Clock Club, a premier luxury fashion rental marketplace that connects individuals wishing to rent out and rent premium men’s bags, clothing, shoes, and accessories. By using our platform, you agree to abide by the following Terms & Conditions. These terms govern your use of the platform, rental of goods, and the services provided by 12 O’Clock Club.
Please read these Terms carefully—they are legally binding. If you do not agree to these Terms, you must not access or use the platform.
IMPORTANT NOTICE: Failure to comply with these Terms may result in account suspension, referral to third-party debt collection, and the impact of your credit score.
2. Account Registration & Eligibility
To access the services on the platform, you must:
- Be at least 18 years old.
- Complete a mandatory ID verification process to ensure you are eligible to rent and lend items.
- Provide accurate and complete information during registration. Failure to do so will result in account suspension.
- Maintain the confidentiality of your account details (username and password). You are responsible for any activity that occurs under your account.
3. Platform Overview
12 O’Clock Club is a peer-to-peer luxury fashion rental marketplace, facilitating the rental of luxury fashion items between users:
- Renters can browse available items and rent them for a specified period.
- Lenders can list their luxury items (bags, clothing, shoes, accessories) for rent to other users.
- We act solely as a facilitator between the parties and do not take ownership of the items.
- We do not authenticate items listed on the platform. It is your responsibility to verify the condition and authenticity of items before renting or lending.
4. User Responsibilities
Renters:
- Payment: Renters are required to pay the full rental price upfront for the entire rental period.
- Inspection: Upon receipt of a rental item, Renters must inspect the item for any defects or damages. If there are issues, the platform must be notified within 24 hours.
- Usage & Care: Renters are responsible for using the items carefully and following any specific care instructions provided by the Lender.
- Timely Return: Renters must return the item by the agreed return date using the secure packaging provided by 12 O’Clock Club, or in an equally secure package.
- Late Returns: Failure to return the item on time will result in a £15 per day late fee. If the item is not returned within 7 days of the due date, the Renters’ account will be suspended, and the item will be reported as lost.
- Loss/Damage: Renters are responsible for any loss or damage to the rented item during the rental period. Renters agree to pay for any repairs or replacement costs based on the condition of the item, up to its full retail value.
Lenders:
- Authenticity: Lenders are responsible for listing only authentic, high-quality items that comply with the platform’s guidelines.
- Item Condition: Lenders must ensure that the items are in excellent condition, cleaned, and free from any significant damage.
- Rental Price: Lenders set their own rental fees, which must be clearly stated on the item listing.
- Inspection: After the rental period ends, Lenders must inspect the item promptly for damage, wear, or loss. If the item is returned damaged, Lenders must notify the platform immediately.
- Item Delivery & Collection: Lenders must promptly ship items to Renters and arrange the collection of returned items. Lenders must ensure proper packaging to prevent damage during transit.
- Late Returns: If a Renter fails to return an item on time, Lenders have the right to charge the daily late fee.
5. Rental Fees & Payments
Rental Fee:
- The rental fee is determined by the Lender at the time of listing the item and is paid in full by the Renter at the time of booking.
- The rental fee includes shipping costs, unless otherwise stated in the listing.
Additional Fees:
- Late Return Fee: Renters will be charged £15 per day for late returns.
- Damage or Loss Fee: Renters are responsible for the cost of repairing or replacing damaged or lost items. The platform will assess the repair/replacement cost based on the item’s retail value.
- Cleaning Fee: A cleaning fee may be charged by the Lender if the item is returned in an excessively dirty condition.
Payment Processing:
- All payments are processed via the platform’s secure payment gateway.
- Renters and Lenders are responsible for ensuring their payment methods are up to date and valid.
- If payment fails, the rental will be canceled, and the item will not be dispatched.
6. Debt Collection & Non-Payment
- If any rental fees, late return fees, damage fees, or any other outstanding balances are not paid in full, 12 O’Clock Club may refer the debt to third-party debt collection agencies.
- Legal Action may be taken to recover any unpaid amounts.
- Non-payment of fees or fraudulent activity will be reported to credit reference agencies, which may negatively affect your credit rating.
7. Item Condition & Damage Claims
- Renters must return the items in the same condition they were received, considering normal wear and tear.
- Lenders are responsible for inspecting the returned items and notifying 12 O’Clock Club of any damage or loss within 7 days of receiving the returned item.
- Claims for damage or loss should be filed through the platform, and Renters may be required to pay for the damage or replacement costs.
- If the item is damaged or lost beyond repair, Renters may be liable for the full retail value of the item.
8. Prohibited Activities
You agree that you will not:
- Use rented items for commercial purposes, including photoshoots, events, or reselling.
- List counterfeit or unapproved items.
- Modify, alter, or repair items without the explicit permission of the Lender.
- Lend items in a state of poor repair or that do not meet the platform’s quality standards.
- Misuse the platform for any illegal activities.
9. Suspension or Termination of Account
12 O’Clock Club reserves the right to suspend or terminate your account if:
- You violate these Terms & Conditions.
- You fail to pay any rental, late return, or damage fees.
- You engage in fraudulent or illegal activities.
- You fail to return an item, or damage it beyond repair.
- You provide false or misleading information.
10. Limitation of Liability
- 12 O’Clock Club is not responsible for any personal injury, loss, or damage caused by the use of rented items.
- The platform is not liable for any disputes between Renters and Lenders.
- Renters and Lenders agree to indemnify and hold 12 O’Clock Club harmless from any claims, damages, or expenses arising from their use of the platform.
11. Amendments
We reserve the right to update these Terms & Conditions at any time. We will notify users of material changes, and the new version of the Terms will be posted on the website and within the app. By continuing to use the platform after changes, you agree to abide by the updated Terms.
12. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
